1. Introduction

Louderband recognizes the importance of privacy in these times and the responsibility that comes with providing its users’ information. Therefore, it has developed this Privacy Policy (hereinafter, the “Policy”) to inform those who register as Users of the “Louderband” application (respectively, the “Users” and the “App”) and the website www.louderband.com (the “Website”) how personal data is received, stored, and processed in its databases (the “Data”).

Users’ registration on the App or Website indicates acceptance of the Policy and their informed consent for Louderband to process their Data under the terms indicated in this Policy. Those who do not agree with the provisions herein may refrain from registering as Users. To contact us with questions and issues related to this Policy, please use the contact methods detailed below.

2. Data Collection

At all times, Louderband will treat Data confidentially, in good faith, and in accordance with the provisions of the National Personal Data Protection Law No. 25,326, Regulatory Decree No. 1558/2001 of the Argentine Republic, and its related and/or future replacement regulations (the “Law”).

Except where prohibited by law or other applicable regulations, Louderband may collect, but is not limited to, the following Data: first and last name, username, email address, address or location, telephone number, website, national identity document, date of birth, age, gender, nationality, profession, IP (Internet Protocol) address, visits to other websites, preferences related to artists and musical genres, product or service brands, and any other information that Users choose to publish in the App or on the Website. Louderband may also collect information related to the use of the App and the Website, such as the frequency and duration of visits, internet browser, device type, interaction with other users, searches, and any other information that Users choose to share when contacting Louderband.

Data will be collected through the following means and on the following occasions:

When a person registers on the App or the Website, completes their information and profile type (Audience, Musician, Producer, Band, Recording Studio, Venue, etc.)

When a person contacts Louderband to receive information.

When a search is performed, or information about a class, search, or service is posted on the App.

Automatically through the use of the App or the Website as established in this Policy.

Through other websites and applications where Users have authorized the sharing of their information with Louderband.

3. Use of Data.

Except in cases where prohibited by law or other applicable regulations, Louderband may use the Data for the following purposes:

· To protect the rights of Users and/or third parties.

· To help improve the functions and tools of the App and Website.

· To personalize the App and Website to provide a better User experience, including content suggestions, whether advertising or not.

· To provide information about Louderband via email. If you do not wish to receive emails, you may request this from Louderband.

· To inform you about changes to the Privacy Policy and Terms of Use.

· To provide information about content, products, and services, whether our own or those of third parties, that Louderband considers of potential interest to Users.

· To respond to inquiries and provide technical and administrative support.

To comply with relevant laws, regulations, processes, and legal obligations.

To implement systems for the provision, promotion, and marketing of products and services, and to send advertisements, offers, and promotions.

To manage, administer, analyze, and investigate relationships between Users, including complaints and reports of misuse.

In compliance with the Law, Users are hereby informed that they have the right to request Louderband to stop sending advertisements, offers, and promotions via email. For this reason, in all advertisements, offers, and promotions, Louderband will: (i) inform Users of their right to withdraw or block, in whole or in part, their Data from the corresponding database and the mechanism provided for exercising such rights; and (ii) provide Users with the opportunity to opt out of receiving further information related to Louderband, its products and/or services, and/or those of third parties.

4. Access to Data.

Except in cases where the App or Website are unavailable for maintenance or due to force majeure, Users may access and update their personal information by logging into and editing their Profile and Account Settings.

Certain information arising from the use of the App and Website may be disclosed to other Users in specific sections of the Website; for example, ratings given by Users in their own Profile or in the details of classes offered, information uploaded to their own Profile, the albums a User participated in, searches for classes (whether published or not), which Users clicked the “Join the Audience” button, the number of Users who clicked the “Applaud” or “Boo” buttons on other Users’ posts, and comments posted on Website content.

Access to the Data is strictly restricted to those individuals who must have access to it for Louderband to fulfill the purposes set forth in this Policy. Louderband will ensure that any person accessing the Data respects and protects the rights of the Users and, at all times, observes and complies with their duty of confidentiality, in accordance with the provisions of Article 10 of the Law.

In this regard, please be advised that Louderband and any person involved in any phase of Data processing are obliged to maintain and respect the confidentiality of the Data, even after the relationship with the Users has ended due to their cancellation of their subscription to the App or Website.

5. International Transfer and Assignment.

Except in cases where prohibited by law or other applicable regulations, Louderband may transfer or assign Data to business partners, related companies, professional advisors, government entities, or service providers only if necessary to fulfill: (i) the purposes for which it was collected; and/or (ii) legal obligations. Likewise, Data may be shared with third parties in the event of, for example, a corporate reorganization, merger, sale of assets, transfer of shares, and/or assignment of stakes of Louderband and/or its directly or indirectly related companies.

While some of the recipients to whom Louderband may eventually transfer or assign Data are located in Argentina, others may be located or carry out relevant operations in jurisdictions whose level of protection may not be equivalent to that granted by law. Notwithstanding the foregoing, Louderband will at all times ensure that the transfer or assignment of Data is carried out in compliance with the requirements established by Articles 11 and 12 of the Law.

In cases where a User decides to share their Data or any other personal information through a public posting on the Website, the User will be responsible for the disclosure of such information, as Louderband cannot control the actions of each User.

Acceptance of this Policy implies acknowledgment that Louderband is not responsible for what Users do with the information that other Users publish.

6. Data Processing. Service Providers

When the processing of Personal Data is delegated to a data processor, or when the provision of a specific service involves the processing of Data, Louderband will formalize the contract in writing (including in the corresponding contract the clauses required by Article 25 of the Law), select a processor/provider who provides sufficient guarantees regarding the adoption of technical and organizational security measures, and ensure that the processor/provider acts on your behalf and according to your instructions.

7. Data Accuracy. User Rights

Users have the right to request: (i) access to their Data and, if applicable, request its update, rectification, or deletion; and/or (ii) the cessation of the sending of advertisements, offers, and promotions. To exercise these rights, Users must prove their identity—this requirement will only be required of those who wish to exercise the rights indicated in item (i) above—and request it in person, in writing, or by email, using the contact information indicated in Section 12 hereof.

Louderband will make its best efforts to allow Users access to their Data within ten (10) calendar days from receipt of the request sent by them.

Likewise, Louderband will make its best efforts to update, rectify, or delete the Data within five (10) business days from receipt of the User’s request or from the moment it becomes aware of the error or falsity of certain Data.

For information purposes, and in compliance with the requirements of the Law, it is hereby communicated that: “The owner of personal data has the right to access their data free of charge at intervals of no less than six months, unless a legitimate interest to that effect is demonstrated in accordance with the provisions of Article 14, paragraph 3 of Law No. 25,326. The NATIONAL DIRECTORATE FOR THE PROTECTION OF PERSONAL DATA, the Control Body of Law No. 25,326, is empowered to address complaints and claims filed regarding noncompliance with the regulations on personal data protection. The owner may at any time request the removal or blocking of their name from the databases referred to in this article. In all communications for advertising purposes made by mail, telephone, or email, the possibility of the data owner to request the removal or blocking, in whole or in part, of their name from the database must be expressly and prominently indicated. At the request of the interested party, the name of the person responsible for or user of the database who provided the information must be provided.

To ensure that the Data stored in the databases is accurate and up-to-date, Users must notify Louderband of any changes to their Data. Furthermore, if Louderband becomes aware of any inaccuracies in the Data stored in its databases, it will correct them at the earliest opportunity.

Louderband will store the Data for as long as necessary to fulfill the purposes for which it was collected. Therefore, Louderband will delete the Data from its databases when it is no longer necessary and, in any case, after the expiration of the maximum storage period established by applicable laws.

8. Databases. Security

Louderband will store the Data in databases that are duly registered with the National Database Registry and will adopt the necessary technical and organizational measures to guarantee security and confidentiality. of the Data, in order to prevent its adulteration, loss, unauthorized access, or processing, and to allow the detection of information deviations.

9. Cookies and Other Technologies

The App, the Website, emails, and advertisements sent by Louderband, among others, may use cookies and/or other similar technologies. Louderband’s objective is to ensure that when using the App and the Website, the User experience is as appropriate and personalized as possible. Through these technologies, Louderband may, among other things, identify the sections of the App and the Website most visited by Users, quantify the effectiveness of advertisements, analyze trends, and provide the most relevant content.

All information collected through these technologies will be processed in the same way as Data.

Users have the option of disabling cookies and web beacons. However, disabling these technologies may prevent Users from enjoying all the features offered by the App and the Website.

10. Links to Third-Party Websites

The App and the Website may include links to third-party websites. In this regard, it is clarified that the processing of Data by the data controllers of the aforementioned websites is not covered by this Policy. Therefore, Users are advised to review the privacy policies that govern the processing of data collected through these websites before browsing or providing their data through these websites.

13. Changes to the Policy

If Louderband decides to substantially modify the way it collects, processes, and/or uses Data, the categories of Data it collects, and/or any other aspect related to this Policy, Louderband will notify Users upon their next visit. Furthermore, this Policy and any future replacement will be available to Users on the App and Website.

14. Applicable Law. Jurisdiction

This Policy shall be governed by the laws of the Argentine Republic. In the event of any dispute or disagreement related to the interpretation, validity, execution, or enforcement of this Policy, the exclusive jurisdiction of the National Ordinary Commercial Courts located in the Autonomous City of Buenos Aires shall apply. Louderband and Users hereby waive any other jurisdiction or venue that may apply.
